The guarantee at a glance

  • We guarantee that your ISO Certificate is issued within 5 Business Days, or we refund our Fee in full (clause 2).
  • The 5 Day Pathway is only for businesses that already run the processes the Standard covers and can show records from their day to day work. We check this and confirm it in writing before you pay (clause 3).
  • The 5 Business Days start the day after four things are done: we confirm you are eligible, the Fee is paid, you give us your evidence and access, and the Certification Body confirms it can audit, decide and issue the Certificate inside the window (clause 4).
  • Days where we are waiting on you do not count towards the 5 Business Days (clause 4.4).
  • Your Certificate is issued by an independent accredited Certification Body, not by us. Its fees are paid directly to it and are not part of any refund (clause 2).
  • If we miss the 5 Business Days for any reason other than those listed in clause 7, you get our Fee back. That includes the Certification Body running late.
  • These terms sit alongside our Terms of Engagement, which continue to apply (clause 1.3).

1. What this document covers

1.1 These are the terms of the 5 Day Certification Guarantee (Guarantee) offered by ISO 9001 Consultants Pty Ltd (ABN 17 664 022 468) (we, us and our). They apply where your Proposal says your engagement is on the 5 Day Pathway.

1.2 These are also the terms and conditions referred to in our advertising for our 5 day offer. They are available to anyone, free of charge, before you buy anything from us.

1.3 These terms sit alongside our Terms of Engagement. If there is any inconsistency about the 5 Day Pathway or this Guarantee, these terms prevail. The Terms of Engagement apply to everything else, including our Money Back Guarantee, confidentiality, your ownership of the documents we create, liability and disputes.

1.4 Words that start with a capital letter and are not defined here have the meaning given in the Terms of Engagement.

1.5 In these terms:

5 Business Day Period
means the five consecutive Business Days worked out under clause 4.

5 Day Pathway
means the fast certification service these terms apply to.
Business Day
means a day other than a Saturday, Sunday or public holiday in Sydney, New South Wales.
Certificate
means the certificate of certification to a Standard issued by the Certification Body.
Certification Body
means the certification body you engage to audit and certify your Management System, being a body accredited by JAS-ANZ or by another accreditation body that is a signatory to the IAF Multilateral Recognition Arrangement.
Eligibility Review
means the scoping discussion and review of your current records that we carry out before you pay, to work out whether your business qualifies for the 5 Day Pathway.
Evidence Pack
means the records and access we ask you for at the Eligibility Review, which usually include your existing procedures and forms, job or project files, inspection and checklist records, training and competency records, plant, vehicle and maintenance records, supplier and subcontractor records, complaints, incidents and corrective actions, and any licences and permits.
Fee
means our consulting fee for the Services set out in the Proposal.
Proposal
means the proposal, blueprint or quote that sets out the Services, Standards and Fee, as accepted by you, whatever it is titled.
Standard
means each ISO standard named in the Proposal, such as ISO 9001, ISO 45001 or ISO 14001.
Start Conditions
means the conditions listed in clause 4.2.

2. What we guarantee

2.1 If your business is on the 5 Day Pathway and your Certificate for each Standard in the Proposal is not issued within the 5 Business Day Period, we will refund the Fee in full, unless clause 7 applies.

2.2 The refund is of our Fee. Certification Body fees are paid by you directly to the Certification Body, so they are not ours to refund. Your own internal costs are not included either.

2.3 The Certificate is issued by an independent Certification Body. We are not a Certification Body, we do not conduct the audit, and we do not make the certification decision. What we do is get your business and your evidence ready, run the work with you, and manage the process with the auditor.

2.4 You may claim under this Guarantee, or under the Money Back Guarantee in our Terms of Engagement, for the same Fee. You cannot claim under both for the same Fee.

2.5 If a delay is caused by the Certification Body running late with its decision or the issue of your Certificate, this Guarantee still applies and you can claim.

3. Who the 5 Day Pathway is for

3.1 The 5 Day Pathway is not offered to every business. It suits a business that already runs the processes the Standard covers and can show what it does day to day, so the work is about reviewing real operations and evidence rather than building a system from nothing.

3.2 Before you pay, we carry out the Eligibility Review and confirm in writing whether your business qualifies. If it does not, we will tell you and offer our standard pathway instead, which has its own timeframe and its own money back guarantee.

3.3 To qualify for the 5 Day Pathway, all of the following must be true at the Eligibility Review:

  1. your business already carries out the processes the Standard covers, and has been doing so for at least the last 3 months;
  2. you can show us records of that work from the last 3 months, of the kind listed in the definition of Evidence Pack;
  3. the scope is one legal entity operating from one main office or depot, with no more than 50 people including regular subcontractors (work carried out at client sites is fine);
  4. you nominate a contact who is available to work with us across the 5 Business Days, and a senior manager who is available for the management review and for the audit;
  5. your records are in English and can be shared with us and with the auditor electronically;
  6. you have no unresolved major nonconformity, suspended or withdrawn certificate, and no current enforcement action, prosecution or serious incident under investigation that relates to the scope;
  7. you have told us everything relevant, including anything in paragraph (f) and any previous certification attempt; and
  8. a Certification Body has accepted your application and confirmed in writing that it can carry out the Stage 1 and Stage 2 audits, complete its certification decision and issue the Certificate within the 5 Business Day Period.

3.4 We may decline the 5 Day Pathway, or move you to our standard pathway with your agreement, at any time before the 5 Business Day Period starts. If you have already paid and we do that before we start work, we refund the Fee in full.

4. When the 5 days start and finish

4.1 The 5 Business Day Period is five consecutive Business Days, starting on the Business Day after all of the Start Conditions are met.

4.2 The Start Conditions are:

  1. we have confirmed your eligibility in writing;
  2. the Fee has been paid in full;
  3. you have given us your Evidence Pack and the access we asked for;
  4. the Certification Body has given the written confirmation described in clause 3.3(h); and
  5. you have confirmed in writing that your nominated contact and senior manager are available across the period.

4.3 We will tell you in writing on the day the Start Conditions are met, and confirm the start date and the finish date. That written confirmation is the reference point for any claim under this Guarantee.

4.4 A day on which your people are unavailable, or on which we are waiting for information, records or approvals from you, does not count towards the 5 Business Days, and the finish date moves out by the same number of days. We will tell you in writing on the day this happens and confirm the new finish date.

4.5 Where the Proposal covers more than one Standard, they run as one integrated audit within the same 5 Business Day Period, and the Guarantee applies to each Standard.

5. What we do in the 5 days

5.1 Our work in the 5 Business Day Period runs as follows. Timing within the week is arranged around the Certification Body’s audit dates.

Day 1 — Kickoff and evidence review. We go through the records you already keep, map them to the Standard, and tell you by the end of the day what is missing and whether anything puts the timeframe at risk.

Day 2 — Gap closure. We write or align only what is missing, based on how your business already works, and you confirm that it is right.

Day 3 — Internal audit and management review. Run by us with your team, and your evidence organised for the auditor. Stage 1 documentation review with the Certification Body.

Day 4 — Stage 2 audit. The auditor reviews how your business actually operates and the evidence behind it. We attend with you and deal with the auditor.

Day 5 — Close out. Close out of any findings, the Certification Body makes its certification decision, and your Certificate is issued.

5.2 If we find at any point that the timeframe is at risk, we will tell you that day, in writing, and tell you what we are doing about it.

6. What you need to do

6.1 The 5 Day Pathway only works if both sides move quickly. During the 5 Business Day Period you must:

  1. give us information, records, access and approvals on the same Business Day we ask for them, unless we agree otherwise;
  2. make your nominated contact available each day, and your senior manager available for the management review and the audit;
  3. make sure that what you tell us, and what you and your people show the auditor, is true, accurate and genuine;
  4. keep operating your processes and keeping your records as documented; and
  5. pay the Certification Body’s fees when they are due.

6.2 Tell us straight away if anything changes during the period, including a change to your scope, sites, activities or people, or any incident, complaint or contact from a regulator.

7. When the Guarantee does not apply

7.1 The Guarantee does not apply where the Certificate is not issued within the 5 Business Day Period because of:

  1. anything you or your people did or did not do, including delay in giving us information, records, access or approvals, or people not being available;
  2. information or records that were not true, accurate, complete or genuine, or something relevant that you did not tell us at the Eligibility Review;
  3. a change you make to the scope, activities, sites or entities after the Eligibility Review;
  4. a major nonconformity raised at the audit about how your business actually operates that cannot be closed within the period, where it arises from something you did not disclose at the Eligibility Review or that changed after it;
  5. a serious incident, legal breach or enforcement action involving your business during the period;
  6. you cancelling, postponing or withdrawing from the audit, or not paying the Certification Body; or
  7. an event beyond our reasonable control, as described in the Events beyond our control clause of the Terms of Engagement.

7.2 If an exclusion applies, we will still finish the work, at no extra charge, and the Money Back Guarantee in our Terms of Engagement still applies to the certification outcome.

8. How to claim

8.1 To make a claim, email us at info@iso9001consultants.com.au, or write to us at the address in clause 8.5, within 30 days after the end of the 5 Business Day Period. Tell us the start and finish dates we confirmed, and include the audit report and any decision from the Certification Body.

8.2 We will assess your claim and give you our written decision, with reasons, within 10 Business Days of receiving it. If we accept the claim, we will pay the refund within 10 Business Days to the bank account you nominate. Any refund includes the GST paid on the refunded amount.

8.3 If we decline the claim, we will tell you which part of clause 7 we rely on and why, and you may refer the matter to the dispute resolution process in the Terms of Engagement.

8.4 You do not need to pay us anything to make a claim. Each party bears its own costs of making or assessing a claim.

9. What this Guarantee does not promise

9.1 Certification shows that your Management System met the requirements of the Standard at the time of the audit. It does not guarantee that your business will not have an incident, injury, complaint or loss, and it does not guarantee that you will win any tender, contract, panel position or prequalification.

9.2 Timeframes for anything outside the 5 Business Day Period, such as surveillance audits, are not covered by this Guarantee.

9.3 The benefits given to you by this Guarantee are in addition to other rights and remedies you have under a law in relation to the Services. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. The Australian Consumer Law also requires us to include the following statement:

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
